Front windshield strip tint?

Has anyone in Texas or anywhere else failed inspection cause of the front window strip tint (eyebrow) installed below the AS-1?

The tint guy told me it would fail inspection if it's below the line.

Tint is a must here, not worried about getting a ticket. Cops here have more important reasons for pulling people over.
