So, I just had to drop my 2016 Tacoma TR D off at the dealer before it's 5000 mile service because of multiple issues. I typed out this letter and gave it to the service manager plus a video email to his account of my transmission being stuck in fourth gear. He told me there is a recent update for the software which controls the transmission. Last time I brought the truck in for this problem they said the update they currently had was not for my Vin number. Apparently, they have new software since my last visit to the dealership. Here is the list of problems I am having, I handed this to the service rep that way there is zero chance of my complaint being ignored. They also said they were going to check the transmission fluid, even though I asked them to do this on the last trip in and they failed to do this for me.

1. It has a intermittent delayed shift into drive when the vehicle is cold, sometimes it will take 3 to 5 seconds when switching from reverse to drive before there is an actual gear shift.
2. It frequently gets stuck in fourth gear even when there is zero grade to they road and it is noticeably worse when the truck is driven in cold weather, such as the last week we had in Eugene Oregon.
3. This is the worst problem with the truck and it leaves me feeling vulnerable to a collision. This has happened since the first day I bought the truck but it was hard to duplicate, now it is happening more often. Last week the truck decided to lunge forward as I was stopped behind someone at a red light. It was as if someone had put their foot on the gas pedal and gave it gas while my other foot was on the brake. I had to put my foot all the way to the floor to hold the brakes on hard to avoid hitting the vehicle in front of me. This also happened leaving super taco on West 11th, as I tried to stop for traffic as I was leaving the parking lot, the trucks RPMs shot up to around 1400 RPMs as soon as I came to a complete stop, I almost lost the nose of my truck as it was sticking out into oncoming traffic. It's no different feeling than if somebody reached over with a foot and stepped on the gas pedal while I had my foot on the brake. This also happened as I left my driveway before proceeding on to territorial Highway which has traffic going 55 mph. As the truck sits now, it's not safe for my family to be in.
4. The passenger climate control knob is getting very stiff to rotate, causing it to stick more frequently when it is cold in the vehicle. The driver side is also starting to have intermittent rotation stiffness. It's hard to make the passenger climate control knob stop on a specified heat number due to a very stiff climate control knob.
5. When backing up in reverse the truck surges as if someone is pumping the gas pedal. It makes it difficult at times to back up smoothly to a trailer, or having to back up any length of distance smoothly.
I would love to check the transmission fluid myself but it has no dipstick, I am wondering if the truck has a fluid issue?
